As many are aware, there was a huge rush to buy and sell pre-approved labors during July-August 2007, when all the priority dates were suddenly made current. Tens of thousands of labors were sold by fraudulent consulting companies to many questionable GC seekers, who hadn�t even started the process till then.
It is those substituted labors which are clogging the pipelines now. Just think, last month EB3-I stood at November 2001. Now it is completely unavailable. It can�t possibly be because so many pending labors with such old priority dates suddenly got cleared this month, and beneficiary of these labors filed 140+485 together. I seriously doubt that a candidate whose labor is pending since such a long time is even keeping that GC process alive. In all likelihood he/she must have moved on in life.

Denatured, looks like no one knows the exact answer. It's only the 2nd year we've had the lottery, and last year it was unexpected so not many people had 2 applications in.
If both of your H1s are approved, then I'd imagine you'd receive two approval notices with different company names on it. I believe you'd then have to choose which one you want to use for your visa stamp, and let the other company know you have to turn down their offer. I imagine they won't be happy about it, but it's your right and if you want to be ethical you can offer to refund their H1B filing fees.
I'm not an expert but from what I know the H1B is always issued for a specific person and a specific company. You are able to change the company on that visa, but the company cannot take the visa that was issued to your name and give it to another employee.

What US will do is also non-deterministic. To gauge it, you can only try to understand the sentiments currently running in politics. Anyway, if you look at the issue I am bringing up, it has the potential to grant everyone their freedom. But maybe I am talking to the wrong person, because you already have your EAD .. well your brains are also welcome in solving the puzzle

If you look at IV's agenda, most of the items benefit EB as a whole. The idea is to reduce number of people being part of quota. If you think in these terms, you should not have any problem in supporting "Exclusion of STEM grads" from regular quota.

As for your stand on MS F1 visa, you remind me of "rkay". He too makes nonsensical statements like you. If there was an violation of law, USCIS would have known it and plugged the loophole. If you have found some "loophole" that USCIS doesnot know, let them know.

If restraints are necessary in any manner under such conditions, they should be the least restrictive type possible to remain consistent with sound security practices.
So the warden can still order restraints.
The Sheriff or his officers are not Wardens. A Warden(the head of a prison) can order it if the inmate has demonstrated a history of assaultive behavior or escaped before. Neither applies. And the restraints have to be the least restrictive, not have both legs and hands shackled.

That sounds like a good plan, but I didn't see a provision for people applied for I-485 and waiting for their dates to become current to add their spouses ? ( Disclaimer : I'm not one of them :) ) How is that going to get tackled ?

The July fiasco has led many of our members to get their EADs and has lulled them into false security. If your goal is just EAD, please continue with what you are doing but if your goal is to get green card or citizenship - NOW has to be your wake up call.

Thats what my question is. I think they just replied to cough up $5K from us.
This is just delaying techniques by USCIS. I think they are assuming that no one is going to pay this much amount and they can hide the BS they are doing!

This is a totally wrong message someone out there put out to make people nervous. Application support centers do no have IO's. The only IO's you will meet would be at a different USCIS facility where you take appointment and stand before the counter and ask the questions.
There will be no reason why someone would meet a IO at the fingerprinting place which generally have technicians and security to monitor the process. You sit in a waiting room alongwith 100 other people, then once your name is called, you do the fingerprinting and get out of the door.
There is no time to mingle with IOs nor there will be IOs(friendly or not) who would be willing to disclose any information to you.
Some people online gloat at having pleasure to spread disinformation. this seems to be the case...

I had an infopass appointment today and the IO there told me a lot. She told me that me and my wife's namecheck and fingerprints were cleared. She also told me that the case has not been assigned and therefore she opened a Service Request for me to expedite the case (dont know if it will help). She also mentioned that there is no memo stating that the vsa numbers have been exhausted.
And believe me.. i overheard the other IOs in the saying that the immigration system is screwed up and the service centers dont know what they are doing... so guys you can see what the system thinks of itself.....
so again as i have said....sit tight and hope and pray ....

Nice to know that. Now on what basis do we believe you and not the other guy? In this anonymous environment you are as much/less credible as the other guy. The best thing for everyone is to keep hopes low and wait till September passes. There's so much information,rumors,gossip doing the rounds to drive everyone crazy.
