I am a MS candidate and planning to start my OPT from October '07 and apply for H1 the coming April....I should be graduating by the year end.
Do you think this is a safe bet?

Eb2 will be better most of the time because many will not be eligible or Job position does not need Masters or 5 years of experience. So it will move fast though it may go back on october. So if possible try to port into EB2 will always be a good idea. CIR or Visa capture bill may not be possible atleast for an year or more. EB1 and EB2 are best bet for next 1 to 2 years.
Dream on about porting from Eb3 to EB2. On an average it is taking more 9 months to get labor clearence that too if it is eb3. if you are trying eb2 that is almost a definite audit. We have a case in our company which was stuck in audit (eb2) for more than an year now. our company and attorney are no longer filing eb2 (offcourse it is a different matter than they are no longer filing any green card application because of layoffs). So unless you are working for a desi "con"sultant company not many american companies (almosy none) are filing eb3 green card perm applications leave alone eb3 to eb2 conversions. Even desi companies are scared shit because USCIS is knocking the living daylights out of them. Even desi companies are scared of filing eb3 green card perm applications leave alone eb2. So good luck with your eb3 to eb2 dream.

Congratulations!!!. what was your Notice Date on I-485 receipt? There is a big thread going on about which date takes precedence

I applied for my 2nd visa extension (1-year extension) after completion of 6 years in the middle of March 2007 (before I-94 expiry). My I-94 expired in the middle of March. I didn't hear from USCIS until the middle of July when they sent a huge list of request for evidence regarding my case (although I've been working on the same company's H1s for last many years now).
Meanwhile, I applied for adjustment of status on July 2nd as a beneficiary on my wife's application. If my H-1B gets rejected after sending the request for evidence for some reason now will I be out of status? Since my 180 days from my last valid I-94 will expire in the middle of September, is it a good idea to go on H4 before the middle of September and reenter the country?
In worst case, what will be my status if USCIS gets back to me, say in October, and says my H-1B extension application has been rejected?
Any input from UN or other gurus is appreciated.

Currently NSC processing time for employment based 485 is 15th Sept. 2007... My notice date is 18th Sept. 2007 (based on case status shown on USCIS site)
Looks like I am going to miss my GC by 3 days and wait till next year :mad: I highly doubt that dates will stay at 2005 during next month bulletin.. (I truly hope I am wrong!)
Published dates are approximate dates for a ball park idea on where cases are for minimizing phone calls. If published date is Sep 8, 2007. It could have a very wide window of reality between (i) someone has looked at least one case of this date, or (ii) All cases upto this date have been seen. Most likely reality is close to first, as USCIS asks you to contact them if your 'receive notice date' is prior to the published date (suggesting that normally they expect all cases by the date should have been processed).
This suggests that there are cases with 'receive notice date' AFTER the published date, which have been opened. So, be optimistic, and hope for the best.

So for July 2nd filers, there notice date would be September 2007. But they all got GC last yr when they made it current till 2006 PD. However processing times arent Sept 2007 even now which makes me believe its the receipt date?
What do you guys think.

Sorry Guys I am asking this question in different threads , as I am unable to conclude any solution for this problem..:o
Let's assume B entered into US on Jan 1st 2004 with Visa stamping Valid till June 2006.
B doesn't have payslips for period of 185 days(aggregate) in his whole stay in US , rest of the time he maintains legal status , but he never travels outside US and applies for his 485 in March 2006.
In this case B is under risk of illegal status for more than 180 days , as he never travelled outside US.
OK agreed , when it's a law we should abide by them.But what are the other options available for B? He can't be covered under 245(K) so this option is ruled out.He needs to forget about GC? Will it be helpful if he contacts good lawyer any hope? Or just rely on luck?

I don't see big deal in this, just bit of information which has no consequences. Visa numbers do/will exhaust at some point in time.
so for real, how does it affect anyone?

For some reason this does not sound right. If there was spillover of 20000+ visas (of course, this was an assumption), have we seen that many approvals? To me the approvals seemed normal, not much.

DOS allocates visa numbers for each month, for consulates across the world and USCIS here to adjudicate 485s. They provide these agencies with the priority dates for approval + a limit. This could have been used up for the month of AUGUST.
The spill over from FAMILY CATEGORY can only be used starting from SEPTEMBER 01 2008. Otherwise it won't go with the interpretation of the law.
Also the spillover from EB1 (for august 2008 and anything remaining for the current year) will be applied on September 01.
So, what this means is: The numbers available as per the visa bulletin for AUGUST is over. Does not mean, it's over altogether.

Did anyone has got their names changed from the new york embassy.
scenario is as follows:-
Given name has both first name and last name
surname is empty.
I want to get it changed and on the embassy website, they are asking for an affidavit.
